Legal Director Spain and Portugal for an international healthcare company.
Legal Director with at least 10 years of previous experience as an in-house lawyer and at a top law firm, or just in a top law firm. Strong business acumen and experience in complex commercial negotiations, public law and international environments is required. English is a must.
Our client is a leading international company group operating in the healthcare sector. It has a portfolio of over 250 companies present in more than 60 countries and over 125.000 employees worldwide. Its medical devices business includes the production and sale of highly advanced technologicaly products and services to provide comprehensive healthcare solutions to hospitals, clinics and patients. This group has a firm compromise towards society and this, together with its business ethics, result in a high value for their clients and end users.It is currently seeking to hire a Legal Director responsible for the medical and diagnosis devices business unit of Spain and Portugal.
The lawyer will be responsible for the Legal Department of Spain and Portugal and will have in-house legal technical support. He/she will provide legal advice to all the business departments of the company to help them achieve their objectives. The candidate will thus assist in finding innovative legal solutions as required by this challenging business, being a true business partner to all the company’s divisions.
The Legal Director will be in close contact with senior executives, will be a member of the Management Committee and will report to the General Manager of the company for Spain and Portugal. He/she will have a dotted line report to the Legal Director for South of Europe.
The Legal Director will be involved in complex commercial and public procurement contract negotiations with hospitals and clinics, as well as in joint venture and collaboration agreements with third parties for the supply of products and the creation or provision of innovative services to clients. He/she will primarily assist the commercial and marketing teams achieve an optimal distribution and supply system, and will be involved in all the stages of the value chain of the business. The candidate will also provide advice on competition law, data privacy and data management-related issues. In addition, the Legal Director will advise in regulatory issues of the medical devices sector, will hold close and regular contacts with health public authorities, and will provide internal training on relevant legal issues. Finally, he/she will liaise with the Compliance team, will manage external lawyers and will be involved in international projects of the Legal Department, in contact with other in-house counsels based in foreign countries.
We are looking for a Spanish qualified lawyer with at least 10 years of experience acquired in a top law firm and as an in-house counsel. Candidates havin experience only in a top law firm may be considered provided that they have done a secondment in or have closely provided advice to international companies. The candidate should preferably come from a company operating in a regulated or an innovative market, which encompasses negotiations of products and services or comprehensive projects/solutions with both the public and the private sectors, such as healthcare (medical devices, pharmaceutical or biotechnology), IT, defense, environment, engineering and the like; and will have a genuine interest for the healthcare sector. He/she will therefore have excellent negotiation skills and legal knowledge of both commercial and public law contracts and litigation, will be familiar or have experience in M&A/Corporate law, and will be used to dealing and handling legal risks related to competition law, data privacy and data management law. In addition, the candidate should be able to work closely with the company’s Compliance team on AML, corruption and other criminal law matters.
A business acumen is indispensable, the candidate being used to solving complex legal matters providing creative and sound advice to the business, participating of its strategy to achieve its objectives and being a partner to it. He/she will be used to dealing with third parties in negotiations, both from the public and the private sectors, and will have been involved in business projects involving various areas of law. Experience in innovative and international and matrix-driven environments is essential, as well as professional rigour, sense of ethics and excellent communication skills.
The candidate will be fluent in English having an excellent command at a professional level.
